Bombay High Court acquits man serving life sentence in 2012 Kandivali case
The Bombay High Court has acquitted Manishprasad Gaud, setting aside the life sentence imposed on him in the 2012 Kandivali child kidnapping and murder case. A bench of Justices Manish Pitale and Shreeram Shirsat held that the prosecution failed to prove a complete chain of circumstantial evidence linking him to the crime, observing that suspicion, however strong, cannot take the place of proof. The court found the last-seen witnesses unreliable, the ransom-call and electronic evidence unsupported by mandatory Section 65B certificates, and the recovery of the body compromised, and ordered Gaud's release on a Rs 50,000 personal bond.
